Please read this agreement carefully before using the web site. By accessing or using the web site, you agree that you are competent and of age to enter into this agreement and to be bound by the terms and conditions below. If you do not wish to be bound by these terms and conditions, you should not access or use the web site. INFOM MEMBERS COMMUNITY(hereinafter referred to as “INFOM”) aims to contribute to enhancing members’ knowledge of forest medicine and supporting their related researches through an online exchange of information, opinions and data. While the information, opinions and data on the web site are about forest medicine issues, it is not a medical treatment for any particular patient.
Clause 1 No Warranties
1.Although INFOM believes the information and data on this site to be accurate and timely, because of the rapid advances in the field of forest medicine INFOM makes no warranty or guarantee concerning the accuracy or reliability the content at this site or other sites to which INFOM links.
2.The opinions presented on the website are those of the discussants only, not those of INFOM.
3.In the event a medical treatment is suggested or discussed on the web site, the said treatment is not necessarily suggested nor recommended by INFOM as the only and/or the best practice. It simply presents the approach or opinion of the discussant(s).
4.INFOM does not warrant that the web site service will be uninterrupted or error free or that any information, software or other material available on or accessible through the web site is free of viruses, worms, trojan horses or other harmful components.
Clause 2 No Liability or Other Damages
Under no circumstances shall INFOM be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from your use of or inability to use this web site, your reliance on or use of the information, opinion or data provided on. In no event will INFOM’s liability or damages to any member or any party ever exceed the amount paid by the concerned member or party to use this software and the materials provided on the software.
Clause 3 Unauthorized Use or Modification
Except to the extent expressly permitted by the laws of the jurisdiction of a member’s residing country, the users or members of this web site may not copy, modify, distribute, or sell any part of the information, data and/or opinions provided from this web site, nor may such users attempt to copy extract the source code of web site software, without a written consent of INFOM.
Clause 4 Deletion of Posted Information and ID, Termination of Web Usage
To ensure the proper operation of the web site, INFOM reserves its rights to delete data and other contents from the web site, to terminate a part or all of the service to a member and/or to invalidate a member’s ID (or IDs, if a member has multiple ones), in the event of any of the following takes place :
1. when a member has violated any of the terms and conditions stipulated in this agreement, or INFOM has a reason to believe a member may have violated or may violate any of terms and conditions stipulated in this agreement.
2. when the payment of membership due is unreasonably delayed
3. when the use of a credit card for the membership due payment is stopped
4. either when the commencement of either bankruptcy or civil rehabilitation proceedings is entered against a member, or when a member files for bankruptcy protection or civil rehabilitation proceedings from creditors, or when INFOM determines that either one of the above mentioned is likely to happen
5.either when a member’s ID(s) is registered or used by anti-social forces or members thereof or related groups, or when INFOM determines that such is likely to happen
6. either when INFOM loses trust in a member, or when INFOM determines it extremely difficult to maintain mutually trustworthy relationship with a member
Clause 5 Copyright Protection
Other than the rights expressly set forth herein, INFOM does not grant you any intellectual property rights on the information, opinions and data provided on this web site and the software thereof. All rights not expressly granted by INFOM are reserved by INFOM and/or its licensors.
Clause 6 Indemnification
Members agree to defend, indemnify and hold INFOM harmless from any and all liabilities, costs and expenses, including attorneys' fees, related to any violation of these terms and conditions by a member(s).
Clause 7 Prohibition of Reuse & License Transfer
Member(s) may not transfer the license of this web site software to a third party.
Clause 8 TERMINATION
INFOM may terminate a part or all of the web site for any reason by giving members a two months’ advance notice.
Clause 9 Settlement of Dispute & Governing Law
1. With regard to the settlement of any dispute between INFOM and members and /or between members themselves, INFOM and members shall first seek an amicable settlement by discussion between the parties concerned.
2. In case a settlement is not reached among the parties concerned, the dispute will be brought forward to a public arbitration association located in Tokyo, Japan(where INFOM is headquartered) .
3. If any concerned party is not fully satisfied with the result of the arbitration, then the dispute may be decided in the Tokyo District Court and its first judgment will be final and binding upon all the parties involved in the dispute.
The court decision shall be made based on the Japanese language version of the agreement.
Regardless of the nature of the dispute the Japanese law governs in the course of the settlement of a dispute.
Clause 10 Changes in Terms and Conditions
INFOM reserves the right to change or modify these terms and conditions at any time. Members shall agree to give effect to such changes or modifications upon their being posted to the INFOM web site.
Clause 11 General Provisions
In case any issue relating to any of the above provision or the web site software is found to be undefined in the above terms and condition, a member(s) shall not make his or her own judgment on the issue, but instead shall consult INFOM headquarters’ secretary general, Dr. Qing Lee at his e-mail address: qing-li@nms.ac.jp.
